And even if they did sell the guy deserved to make money off any sucker who would have paid money for plans that he could have gotten free just from clicking the picture in the auction which took me right to unfettered access at http://junell.smugmug.com/gallery/215897/1/9121082/Large

Actually he did sell my plans. Although this particular auction didn't sell, he had a few others that did go through. He didn't make much money, but he made some.
I disagree that the guy deserved to make money off some sucker. The plans are my intellectual property, and belong to me. What he did was actionable in court (although certainly not worth pursuing).
Did you copyright the plans? After looking around the net it seems the plans are fairly simple and common. Racetrack tables are common in many casinos, poker rooms etc, I don't know how you could claim any property rights to an item that has been in existance for some time.

You don't have to copyright your plans to possess intellectual property rights. I'm an attorney and I've seen many cases where people took someone's work and passed it off as their own. This is a violation of the law (whether or not the work is formally copyrighted).
And yes, you're right that there are plenty of other plans on the Net. He is free to publish plans on building racetrack tables, but he cannot publish "my" plans and pass them off as his own. He can't used my photographs either.
Aside: Although there are tons of plans around the Net, you'll find that my racetrack plans were the first of their kind and were up long before most of the other websites (see how many times my plans are discussed in Scott Keen's forum).
If you see racetrack plans on the Net, it's almost a certainty that the ideas and techniques in them, came from me. All of which I have no problem with, so long as they use their own instructions and photographs.
