I agree with the analysis. However, there might be an argument from the government that poker is a "sports event". After all it is on ESPN. Of course, it's not a sport, in the pure sense of the word. But in my experience, if they want to prosecute conduct, they can find a way to do it.
However, the point of the article is rather moot. The government is not, and has not, been enforcing the legality of online gambling. There is the complicated issue of where the gambling actually takes place (on your home pc or offshore where the laws aren't the same).
